ORDINANCE NO. 17

ORDINANCE OF THE GOVERNING BOARD OF SUMMERLAND SANITARY DISTRICT AMENDING ORDINANCE NO. 15 AND ADDING A PROVISION RELATING TO LIFT STATION CHARGES

Be it ordained by the Governing Board of SUMMERLAND SANITARY DISTRICT as follows:

RECITALS

  • A. Ordinance No. 15 was adopted following a public hearing on June 13, 2013 as required by California Constitution Article XIII (D) establishing service sewer rates and charges.
  • B. Ordinance No. 15 also established a new category of charges for parcels served by a sewer lift station.
  • C. It has been determined that some parcels subject to the lift station charges may be charged more than the proportionate cost of providing lift station services to those parcels.
  • D. The Governing Board of the SUMMERLAND SANITARY DISTRICT has determined that a procedure for a reduction in lift station charges for such parcels should be adopted.

1. The following provision shall be added to the provision for lift station charges as follows:
“When, in the opinion of the Governing Board of the SUMMERLAND SANITARY DISTRICT and General Manager, a lift station charge appears to be disproportionate to the cost of providing lift station services to a parcel based on reliable evidence, the District may reduce the charge. The reduction may be to an appropriate amount based on the new or modified evidence which is proportionate to the cost of providing the lift station services to the particular parcel.

2. In all other respects, Ordinance No. 15, shall remain in full force and effect as adopted.”

3. Pursuant to Section 21080 (8) of the Public Resources Code and 14 Cal Code of Regs, Section 15273 (a), the Board finds and determines that:

(a) The establishment of charges, rates and fees imposed by this Ordinance are exempt from the requirements of the California Environmental Quality Act (c) for the reasons set forth in Section 21080 of the Public Resources Code; and
(b) The changes, rates and fees adopted hereby are for the purposes set forth in the above-cited provisions.
Publication and Effective Date

4. This Ordinance shall be published or posted in accordance with California Health and Safety Code Section 6490 and shall be effective as of July 1, 2015.
