ORDINANCE AND ORDER OF THE GOVERNING BOARD OF THE SUMMERLAND SANITARY DISTRICT AMENDING ORDINANCE NO. 10, SECTION 6. MISCELLANEOUS FEES
Recitals
A. Ordinance 10 was adopted by the Board of Directors of the Summerland Sanitary District (“Board”) on June 20, 2008 establishing a new Capital Recovery Fee and Miscellaneous Fees.
B. Government Code sections 66013 through 66018 establishes the requirements for the adoption and administration of such fees and the Board intends to adopt a fee that fully complies with the current statutory requirements.
C. A public hearing has been held as required by Government Code section 66016 on February 8, 2018 and the District engaged the firm Raftelis Financial Consultants, Inc. to analyze the Districts Miscellaneous fees and it has rendered a written report and recommendations on December 17, 2017 in which was a part of the record of the proceedings.
D. The Governing Board of the SUMMERLAND SANITARY DISTRICT has determined that a new miscellaneous fees schedule as presented by the financial report of Raftelis Financial Consultants dated December 6, 2017 should be adopted, because the evidence shows that the compensation for the cost of various administrative services provided was substantially lower than that established previously by Ordinance No. 10, section 6.
NOW, THEREFORE, BE IT ORDAINED as follows:
Section 6. Miscellaneous fees. The following miscellaneous fees shall be charged on all new or amended connections:

Sewer Construction Fee | Deposit of 3.5% of estimate of public sewer improvements, which will be credited against the cost when the work is completed. Following final inspection of the construction of the sewer facilities the amount paid shall be reconciled so that the inspection fee represents the actual cost of inspection, billed at $123 an hour. |

This Ordinance shall be published one time as required by Section 6490 of the Health and Safety Code and shall be effective as of the expiration of the week of publication as established either by a proof of publication from the newspaper in which the Ordinance was published or by a subsequent order of the Board that publication has been properly made.
